What to do if you work in an Unsafe/Unhealthy Environment.

If your employer is exposing you to unsafe working conditions, you may be able to resign and claim constructive dismissal- and you may be entitled to compensation. 


Some examples of unsafe conditions: 

  1. Presence of: Mould; Excessive Dust; Bees, Pests or Rodents; or Toxic Fumes/Substances, without PPE

  2. Poor Ventilation 

  3. Unreasonably Unsanitary/Filthy Conditions 

  4. Lack of Essential Amenities- Water, Electricity, Bathroom Facilities 

  5. Lack of Proper Security (particularly if you work in an unsafe area) 


If your employer has been exposing you to such unsafe conditions, here are the steps you should take: 

  1. Raise the issue in writing. Write to your employer outlining the unsafe/unhealthy conditions and how it has been affecting you.

  2. Request that your employer fix the issue. Ask that your employer correct the issue to ensure your health and safety.

  3. State the consequence. State that if the employer fails to fix the issue, you may have no choice but to resign on the basis of constructive dismissal. 


If you resign and claim constructive dismissal because your employer has created an unsafe working environment, you may be entitled to compensation.


But you should always seek proper advice before resigning your job.


Actually, if you are in such a situation, you should seek advice as early as possible to try to address the problem.


Additionally, if you suffer an injury due to an unsafe/unhealthy working environment, you may be entitled to compensation for the injury suffered.
